GENERAL TERMS AND CONDITIONS FOR ONLINE CONTRACTING
Telecommunications Services – Online Contracting
1. Identification of the Operator
These “General Terms and Conditions” govern the contracting of electronic communications services offered through the website fibwi.live by:

FIBWI operates as a duly authorized electronic communications operator in accordance with applicable regulations.
2. Purpose of the Contract
This contract governs the conditions applicable to the online contracting of telecommunications services offered by FIBWI, which may include, depending on the current commercial offer:
- Internet access (any technology).
- Fixed telephony services.
- Mobile telephony services.
- Television services.
- Associated or complementary services.
The specific characteristics of each service (speed, price, minimum commitment, equipment, etc.) are detailed in the commercial offer selected by the customer, which forms an integral part of the contract.
3. Contracting Process
Electronic contracting is carried out through the following steps:
- Selection of the service or tariff.
- Entry of the requested information.
- Express acceptance of:
- these General Terms and Conditions,
- the Privacy Policy,
- and, where applicable, the specific terms of the selected offer.
- Confirmation of the request.
The contract shall only become effective once validated by FIBWI, which may request additional documentation to verify the identity of the applicant or the technical feasibility of the service.
4. Requirements for Contracting
In order to contract the services, the customer must:
- Be at least 18 years old, or 16 years old and legally emancipated.
- Provide accurate, complete, and up-to-date information.
- Be the owner or authorized user of the installation address.
FIBWI reserves the right to reject service requests where objective reasons exist, including but not limited to technical infeasibility, risk of fraud, or prior breaches.
5. Prices, Billing, and Payment Method
The applicable prices shall be those indicated in the commercial offer in force at the time of contracting and include applicable taxes, unless expressly stated otherwise.
Billing shall be carried out with the frequency indicated in the offer (generally monthly), using the payment method selected by the customer from those offered by FIBWI.
Non-payment of an invoice may result, after prior notice to the customer by any means, in suspension of the service and, where appropriate, termination of the contract in accordance with applicable regulations.
6. Contract Duration and Minimum Commitment
The contract shall have the duration indicated in the selected commercial offer.
If the service includes a minimum commitment period, this shall be clearly and explicitly communicated prior to contracting.
Failure to comply with the minimum commitment may result in a proportional penalty charge, in accordance with applicable regulations.
7. Right of Withdrawal
Where the customer qualifies as a consumer and the contract is concluded remotely, they shall have a period of 14 calendar days from the conclusion of the contract to withdraw, without providing justification.
Withdrawal must be communicated unequivocally to FIBWI through any of the available contact channels.
If the customer expressly requests the service to begin during the withdrawal period, they shall pay the proportional amount corresponding to the services effectively provided and any installation, assembly, civil works, or similar costs incurred by FIBWI to enable the service.
8. Equipment and Materials
Equipment installed by FIBWI (router, ONT, antenna, or any other device) may be provided:
- Under a loan, rental, or deposit regime, depending on the commercial offer.
Unless expressly stated otherwise, such equipment remains the property of FIBWI and must be returned upon termination of the service within the deadlines established in the contractual conditions.
Failure to return the equipment may result in a charge corresponding to its value, in accordance with the contractual terms.
9. Service Quality and Customer Support
FIBWI shall provide services in accordance with the quality levels required by applicable regulations and as specified in the contracted offer.
Customers may submit inquiries, incidents, or complaints through the available customer service channels.
10. Personal Data Protection
Personal data provided during the contracting process shall be processed in accordance with the Privacy Policy, available on the website.
The customer declares that they have read and understood this policy prior to contracting.
11. Proper Use of the Service
The customer undertakes to use the services in accordance with the law, good faith, and these Terms and Conditions, refraining from unlawful, fraudulent, or abusive use that may affect the network or third parties.
FIBWI may adopt appropriate measures in the event of improper use of the service.
12. Modification of the Terms
FIBWI may modify these General Terms and Conditions for valid reasons, informing the customer in advance where required by applicable regulations.
13. Termination of the Contract
The contract may be terminated by either party in accordance with applicable regulations and these Terms and Conditions, without prejudice to any outstanding financial obligations.
14. Applicable Law and Jurisdiction
This contract shall be governed by Spanish law.
- Where the customer qualifies as a consumer, the competent courts shall be those of the customer’s place of residence.
- In all other cases, the parties expressly submit to the Courts and Tribunals of Inca (Balearic Islands, Spain).
